Terms and conditions
These terms cover the martingale.io website, the public Martingale Bench and the martingale-check command line tool. By using them you agree to what is written here.
Scope
“Martingale”, “we” and “us” mean Martingale, the company that publishes this site. These terms apply to the website at martingale.io, to the public bench at martingale-bench.vercel.app, and to the martingale-check package published on npm.
They do not cover the Martingale monitoring service (the proxy, Canary suites, drift detection, alerting and dashboard). Customers use that service under a separate written agreement, which takes precedence for anything it covers.
How we handle personal data is described in the privacy policy, which forms part of these terms.
Using the site
You may browse the site, link to it and quote it with attribution. You may not:
- interfere with the site or its hosting, or probe, scan or test it for vulnerabilities without written permission;
- send automated requests to the careers application endpoint, or submit applications that are false or not your own;
- upload files that contain malicious code, or anything you do not have the right to share;
- copy the site’s design, text or marks to present another product as Martingale’s.
The public bench
The bench publishes measurements of public model endpoints, taken by Martingale on its own schedule. Each figure describes what we observed at one point in time. Figures change as endpoints change and as our methods improve.
You may read, cite and link to bench data with attribution to Martingale. Bench data is not a guarantee of any provider’s behavior, and it is not advice about which provider to use.
The martingale-check CLI
The CLI is distributed through npm under the license included with the package. It runs on your own machine and sends prompts to the endpoint you configure, using credentials you supply. You are responsible for your provider account, for the usage charges those prompts incur, and for complying with your provider’s terms.
A check is a one-time comparison of response patterns with a published reference. A CONSISTENT result means no difference was detected under those checks; it does not prove which model answered. A MISMATCH result reports a detected difference; it does not establish the cause.
Applications and demo requests
When you apply for a role, you confirm that the information and resume you submit are accurate and yours. Submitting an application does not create an employment relationship or an obligation on either side. We may contact you at the address you give about the role you chose.
Emailing us to request a demo starts a conversation. It does not create a contract, reserve capacity or commit either side to anything until a separate agreement is signed.
Intellectual property
The site’s text, design, illustrations and code, the Martingale bird mark, and the names Martingale, Canary and Raven belong to Martingale. Customer and provider names and logos shown on the site belong to their respective owners and do not imply endorsement of Martingale beyond the fact of being a customer.
Third-party links
The site links to npm, Vercel, our customers and other sites we do not control. Their content and terms are their own, and a link is not an endorsement.
No warranty
The site, the bench and the CLI are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy and non-infringement. We may change, suspend or remove any part of them at any time.
Limitation of liability
To the fullest extent permitted by law, Martingale is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the site, the bench or the CLI. Our total liability for any claim relating to them is limited to 100 US dollars. Nothing in these terms limits liability that cannot be limited by law.
Governing law
These terms are governed by the laws of the United States and of the state in which Martingale is organized, without regard to conflict-of-law rules. Disputes will be brought in the courts of that state, and you consent to their jurisdiction. If any part of these terms is found unenforceable, the rest remains in effect.
Changes to these terms
We may update these terms. The effective date at the top shows the current version, and continuing to use the site after a change means you accept the updated terms.
